1. What "Royalty-Free" Means

Royalty-free does not mean free. It means you pay once (your DeTonic subscription) and then use the Generated Track as many times as you want, in as many projects as you want, without paying per-use royalties.

Traditional music licensing requires you to pay a fee every time your project generates revenue or reaches an audience (per-stream royalties, sync fees, broadcast royalties). DeTonic's royalty-free license eliminates all of that. Once you generate a track, you have a perpetual, worldwide license to use it without any additional payments to DeTonic.

In plain language: You generate a track, you download it, you use it in your YouTube video / podcast / ad / game / film. No royalty clock is ticking. No licensing fees. No checking back with us.

3. Attribution Requirements

Free tier: We ask (but do not legally require) that you include "Made with DeTonic" in your project's credits or description when publishing Generated Tracks publicly. This helps us grow organically. It is a courtesy, not a contractual obligation.

Creator and Pro tiers: No attribution required. Use Generated Tracks in client work and commercial projects without mentioning DeTonic.

You may not imply that DeTonic endorses you, your organization, or your project without our written permission.

4. Exclusivity & Uniqueness

Important: DeTonic licenses are non-exclusive. We do not offer exclusive licenses.

DeTonic's synthesis engine generates audio based on mood, genre, tempo, and duration parameters. Two users submitting similar prompts may receive similar-sounding results. We make no guarantee that any Generated Track is unique, original, or exclusive to you.

If exclusivity is required for your use case (e.g., a brand jingle that must not appear in competitors' content), DeTonic is not the right tool. We recommend a human composer for exclusive-use music.

Each Generated Track is probabilistically distinct — the synthesis engine introduces variation — but similarity cannot be ruled out. The responsibility to verify that a Generated Track does not conflict with an existing exclusive license in your industry rests with you.

5. Content ID & DMCA Safe Harbor

YouTube Content ID. DeTonic does not register Generated Tracks with YouTube Content ID or any other automated fingerprinting system. When you upload a Generated Track to YouTube, you will not receive copyright claims from DeTonic.

However, our synthesis engine is designed to produce original output — not to reproduce existing songs. If you submit a prompt specifically designed to reproduce a copyrighted song and the output is substantially similar to that song, the resulting track may be subject to claims by the original rights holder. Our content filter blocks known infringement attempts, but is not infallible.

DMCA Safe Harbor. DeTonic operates under the DMCA safe harbor provisions (17 U.S.C. § 512). We respond promptly to valid takedown notices. See our Copyright Policy for the full takedown procedure.

Your DMCA indemnification. If a third party sends a DMCA takedown to a platform where you published a Generated Track, that is between you and the platform. DeTonic is not a party to claims arising from your downstream use of Generated Tracks.

7. What Happens if Your Subscription Lapses

Tracks generated before lapse: You retain your license to use them. A lapsed subscription does not revoke rights already granted for tracks you generated while subscribed. Download your tracks before your subscription ends.

Access to the generator: You lose access to generate new tracks once your subscription lapses. Free tier limits apply if you remain on the free plan.

Track storage: Generated Track URLs expire 90 days after generation regardless of subscription status. If you did not download a track within that window and your subscription has lapsed, the file may no longer be retrievable.

Action: Always download tracks you intend to keep. Do not rely on DeTonic's CDN as long-term storage.

8. International Use

The royalty-free license granted by DeTonic is worldwide. You may use Generated Tracks in any country without additional licensing fees.

Some countries have performance rights organizations (PROs) that collect royalties for public performance of music (ASCAP, BMI, SESAC in the US; PRS in the UK; SOCAN in Canada). Because DeTonic tracks are AI-generated originals not registered with any PRO, you do not owe PRO royalties for using them. DeTonic does not register Generated Tracks with any performing rights organization.

Local laws governing AI-generated content vary. We recommend consulting local legal counsel for high-stakes commercial uses in jurisdictions with specific AI content regulations.
